These Terms & Conditions (“Terms”) govern your use of The Obsidian Crest website and your participation in applications, invitations, bookings, events and experiences organised by The Obsidian Crest (“we”, “us”, “our”).
By using our website, submitting an application, accepting an invitation, making a booking or attending an event, you agree to these Terms where applicable.
About The Obsidian Crest
The Obsidian Crest creates private, curated gatherings, events and experiences.
Each evening is individually curated and attendance may be subject to application, invitation, guest selection, availability and any additional requirements communicated in relation to the particular event.
Applications and guest selection
Individuals may apply to be considered for invitations to The Obsidian Crest events.
Submitting an application does not guarantee an invitation or attendance at any event.
The Obsidian Crest operates a curated guest selection process and reserves the right to accept or decline applications where reasonably necessary to maintain the nature, capacity, security or intended experience of an event.
Each event is considered individually. Being invited to or attending one event does not create an entitlement to attend future events.
We may contact applicants for additional information where reasonably necessary to consider an application.
Invitations and private access
Events may be accessible by private invitation only.
Invitations may include a unique invitation code or other access information. Invitation codes are intended for the recipient and should not be published, distributed or shared without our permission.
Possession of an invitation code does not by itself guarantee admission. We may take reasonable steps to verify the identity or eligibility of a guest.
Event details made available through a private invitation or access code should be treated as confidential where the nature of the event reasonably requires it.
We reserve the right to deactivate or replace an invitation code where reasonably necessary, including where a code has been shared without permission, compromised or misused.
Event details
Event dates, times, locations, dress requirements and other information will be communicated to invited guests where appropriate.
We may make reasonable changes to event arrangements, including the venue, timings, programme, suppliers or other details where circumstances require.
Where a significant change affects a confirmed booking, we will endeavour to inform affected guests as soon as reasonably practicable.
Bookings and payments
Where an event requires payment, the applicable price and payment arrangements will be communicated before a booking is confirmed.
A booking is not confirmed until any required payment has been received and we have issued confirmation, unless we expressly state otherwise.
You are responsible for ensuring that information supplied when making a booking is accurate and complete.
Any additional charges or optional services will be made clear where applicable before they are purchased.
Cancellations and refunds
Cancellation and refund arrangements may vary depending on the particular event, venue, suppliers and commitments made on behalf of guests.
Any event-specific cancellation terms will be communicated before or at the time a paid booking is made.
Where you cancel a paid booking, any refund entitlement will be determined by the cancellation terms communicated for that booking and your applicable rights under UK law.
Nothing in these Terms limits any cancellation, refund or other rights that cannot lawfully be excluded.
Cancellation or changes by us
Occasionally, circumstances outside our reasonable control may require us to change, postpone or cancel an event.
These circumstances may include venue issues, supplier failure, severe weather, travel disruption, safety concerns, illness, government restrictions or other events that could not reasonably have been prevented.
If we cancel or materially change a paid event, we will communicate with affected guests regarding the options available, which may include a refund, transfer or alternative arrangement depending on the circumstances and applicable law.
Guest conduct
Guests are expected to behave respectfully towards other guests, staff, venues, suppliers and members of the public.
We may refuse admission or require a person to leave an event where their behaviour is reasonably considered unsafe, threatening, abusive, discriminatory, disruptive or otherwise likely to adversely affect the event or other guests.
Guests must comply with reasonable venue rules, safety instructions and applicable laws while attending an event.
Dietary and accessibility requirements
Guests should inform us of relevant dietary requirements, allergies or accessibility requirements within any timeframe communicated for the event.
We will take reasonable steps to communicate relevant requirements to venues, caterers and other appropriate suppliers.
While reasonable efforts will be made to accommodate requirements, we cannot guarantee that every request can be accommodated in every venue or circumstance.
Guests with serious allergies or other requirements that may affect their health or safety should contact us before attending so that appropriate arrangements can be discussed.
Photography and filming
Photography and filming may take place at The Obsidian Crest events and related content shoots.
Where appropriate, information about photography or filming will be provided in advance or at the event.
Where consent is required for a particular use of an identifiable image, we will seek that consent as appropriate.
Guests who have concerns about appearing in photography or filming should contact us before attending or speak to a member of the event team.
Website use
You may use our website only for lawful purposes.
You must not knowingly interfere with the operation or security of the website, attempt to gain unauthorised access to restricted areas or systems, misuse invitation access functionality, or use the website in a way that could damage or impair its operation.
We may update, suspend or withdraw parts of the website where reasonably necessary for maintenance, security, development or operational reasons.
Intellectual property
Unless otherwise stated, the branding, website design, text, graphics, photographs, video and other original content published by The Obsidian Crest are owned by us or used with appropriate permission.
You may not reproduce, distribute, commercially exploit or substantially copy our content without prior permission, except where permitted by law.
Third-party venues and suppliers
Our events may involve independent venues, caterers, hospitality providers, photographers, transport providers and other third-party suppliers.
Certain services may therefore also be subject to reasonable terms, policies or requirements imposed by the relevant third-party provider.
We are not responsible for the independent acts or omissions of third parties except to the extent that responsibility cannot lawfully be excluded or where we are legally responsible for their performance.
Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to applicable law, we are not responsible for losses that were not reasonably foreseeable when an agreement between you and us was formed.
We are not responsible for loss or damage caused by your failure to follow reasonable event instructions, venue rules or information provided to you.
Nothing in these Terms affects your statutory rights as a consumer.
Personal belongings
Guests are responsible for their personal belongings while attending an event.
We recommend taking reasonable care of valuables and following any cloakroom, storage or security arrangements provided by the venue.
Privacy
Personal information collected through applications, bookings, communications and events is handled in accordance with our Privacy Policy.

Changes to these Terms
We may update these Terms from time to time to reflect changes to our services, events, business practices or applicable legal requirements.
The latest version will be published on our website with the relevant last-updated date.
Where a material change affects an existing confirmed booking, the terms applicable to that booking will remain subject to applicable law and any specific terms already agreed.
Governing law
These Terms and any dispute or claim arising out of or in connection with them are governed by the applicable laws of the United Kingdom, subject to any mandatory rights or protections available to you under applicable law.
Nothing in these Terms prevents a consumer from relying on any mandatory rights regarding the courts or laws applicable to them.
